John, Justice Samuel Alito must be impeached.
Why? Right after the 2021 Capitol Insurrection and just days before President Biden’s inauguration, Justice Alito flew an upside down American flag outside his home — a symbol that showed support for the violent rioters who led a coordinated attack on the heart of our nation’s democracy.
Then, just last year in 2023, another flag was spotted flying from the Alito home’s flagpole. This time, it was the “Appeal to Heaven” flag, which has been co-opted by Christian nationalist groups and the “Stop the Steal” movement — and this flag was also carried by Jan. 6th radicals.
The Supreme Court is now hearing cases related to January 6th and will rule on the possibility of presidential immunity for Donald Trump. He’s publicly aligned himself with the criminals who carried out the insurrection — it’s clear he can’t rule impartially.

Alito’s use of the “Appeal to Heaven” flag is concerning to us for other reasons, too. As a Supreme Court justice, Alito is expected to uphold the law of the land, the American Constitution, but the history of the flag is aligned with a belief that the law of God must be above all, which subverts the notion of separation of church and state America was founded on.
According to the Supreme Court’s own new (and non-binding) Code of Ethics, “a Justice should disqualify himself or herself in a proceeding in which the Justice’s impartiality might reasonably be questioned.”
Justice Alito’s impartiality is compromised.
