This morning, the U.S. Supreme Court rejected a case brought by pro-life medical professionals who wanted to restore FDA regulations on the chemical abortion drug mifepristone.

You probably know that mifepristone is the first of two drugs in the chemical abortion regimen. It blocks a pregnant woman’s production of progesterone, causing the unborn human being in her womb to starve to death [[link removed]].

Today, the Supreme Court tossed out the case, saying the pro-life medical professionals didn’t have legal standing to sue.

We are deeply disappointed by the U.S. Supreme Court’s decision today. The FDA’s policy changes loosening safeguards for this drug put pregnant women in danger and are lethal to the unborn.

“It is a sad day for all who value women’s health and unborn children’s lives,” Susan B. Anthony (SBA) Pro-Life America state policy director Katie Daniel said. But she added that “the fight to stop dangerous mail-order abortion drugs is not over.” Live Action president Lila Rose pointed out that today’s decision is purely “procedural” and predicted that the substance of the case “will be back at SCOTUS soon.”

We had really hoped the Supreme Court would have been able to decide on the merits of the case and restore safeguards on mifepristone.

But it’s not over yet!

It’s possible the complaint may still continue in federal court.

Three states – Idaho, Kansas, and Missouri – previously intervened in the lawsuit in district court and attempted to do so at the U.S. Supreme Court.

They could decide to continue the legal action and attempt to demonstrate that they possess the legal standing that the original plaintiffs didn’t have.

I’m urging our pro-life neighbor Idaho, as well as Kansas and Missouri, to proceed with this important litigation.

Since the FDA is unwilling to stand up against the abortion industry on behalf of women, we must.

Pro-life advocates across the country must demand accountability from the FDA and seek protections for women and the unborn.
