Two major Supreme
Court rulings were handed down today – the first on abortion rights
and the second on labor rights.
It’s a mixture of good news and bad, for
now. Let’s talk about what happened and where we go from
here.
First, in a unanimous decision, the court
temporarily halted attempts by extremist, anti-abortion groups from
blocking distribution of the medication mifepristone – one of the two
drugs used in safe, at-home medical abortions.
Mifepristone has other medical uses as well,
including treatment following a miscarriage to prevent sepsis, and to
treat other complex reproductive health issues.
Had the Supreme Court sided with the
anti-abortion groups today, it would have meant blocking mail-order
access to this medication even in states where abortion is legal and
protected.
But
here’s the catch.
While today’s ruling is a victory for abortion rights and bodily
autonomy, the fight is not over. The conservative justices sent a
clear message that they will hear the case again and rule differently
if these groups bring a better case with “the right
plaintiff.”
Lest we forget: The only reason we
are living through this nightmare, fighting for the right to control
our own bodies again, is because Democrats chose to spend the last 50
years treating bodily autonomy as a fundraising gimmick instead of a
fundamental civil and human right.
Even in the wake of the Dobbs decision, Democrats had the opportunity to pass abortion
protections into law while they controlled both chambers of Congress
and the White House. And Biden has considerable power under the
Executive Branch to protect abortion
access.
They choose not to use that power,
because it’s easier to fundraise on fear than to deliver
results.

In the second
major case decided today, a nearly
unanimous court savagely undercut the authority
of the National Labor Relations Board and ruled in favor of Starbucks
in their union-busting case.
The result will give corporate thugs like Starbucks and Amazon
carte blanche to continue steamrolling employees attempting to assert
their power and safeguard their rights through collective
bargaining.
Even the lone justice who dissented,
Justice Ketanji Brown Jackson, concurred with the majority ruling but
disagreed with a few specifics.
Given the widespread reporting of corruption
among the Supreme Court – with details of millions of dollars in
lavish gifts, favorable insider stock deals, and unexplained income
for their spouses – the naked bribery is there for all to
see.
There is only one
remedy to the cancer of corruption that currently infects our highest
court: We need a radical overhaul of the Supreme
Court.
There is
entirely too much power vested in this oligarchy of nine – and no
accountability. As president I will DOUBLE the number
of Supreme Court justices from 9 to 18 to better reflect the growth of our
population and scope of our federal court system. I will also impose term limits of 18 years
and stagger the term limits so that a new seat opens each
year.
We will pass
legislation requiring a two-thirds supermajority from the Supreme
Court for all cases involving judicial review of federal
laws.
Finally, to excise
the corruption for good, we will establish a binding code of ethics
for all Supreme Court justices so that they are held to the same
standard – or higher – as any federal
judge.
Never again will a single president have
the power to put an ideological lock on the court for a generation.
And never again will justices have unchecked power to lord over
everyday Americans or escape accountability for their
corruption.
Those
are the checks and balances our founders envisioned and that modern
