Today, in a unanimous decision, the U.S. Supreme Court ruled that the Alliance for Hippocratic Medicine lacked standing (that is, the legal right) to challenge the FDA's approval of the abortion drug mifepristone.
Since the landmark Dobbs victory that overturned Roe v. Wade, the Left's fight for abortion has only intensified. Not only are they still trying to pass federal legislation that would allow abortion up until birth in all 50 states at taxpayer expense, but they've also sought to expand the distribution of chemical abortion pills, especially in states that protect life.
According to some estimates, more than 60 percent of abortions are performed using a drug called "mifepristone," more commonly known as the "abortion pill."
The abortion pill is of particular importance to the Left and their pro-abortion allies, because it costs less than surgical abortions, doesn't currently require an in-person examination in order to receive a prescription, and can more easily flout the laws pro-life states have passed to protect life.
However, chemical abortion poses a grave threat not only to the unborn child in the womb but also to the mother. Health risks associated with chemical abortions include severe bleeding, infection, retained fetal parts, the need for emergency surgery, and even death.
This drug is dangerous, and many in America are waking up to this truth. That's why a group of pro-life medical professionals, the Alliance for Hippocratic Medicine, filed a lawsuit with a District Court in Texas in 2022, arguing that the FDA's approval of mifepristone was improper. The judge agreed, and his ruling suspended the drug's regulatory approval from the FDA.
The Biden administration and mifepristone's manufacturer appealed to the U.S. Supreme Court to overturn the lower court's decision. FRC filed an amicus brief in support of the Alliance for Hippocratic Medicine because they're right to raise the alarm about the dangers of mifepristone.
However, the Court unanimously ruled that the doctors did not have the legal standing to bring the case. It is important to note that the Court did not rule on a number of issues contained in the lawsuit about the safety procedures that have been dropped by the FDA; these questions could still come up in a future case being advanced by the states of Idaho, Kansas, and Missouri.
Irrespective of the Court's decision, Family Research Council's commitment to life remains unshaken. Even as our culture moves further and further away from valuing life, our stance remains rooted in the Word of God.
