BREAKING: For now, the U.S. Supreme Court has maintained access to mifepristone, a safe and effective abortion medication.

This shows once again what we've always said: Abortion is health care, and nobody should interfere with decisions that should be between patients and providers.

While this victory means patients in states where abortion is legal can still get medication abortion using mifepristone, this fight is not over.

The case will be sent back down to the federal district court, which has already allowed the states of Kansas, Missouri, and Idaho to intervene in the case. This means the case could continue with the states as parties. And this ruling does nothing to restore care for the millions of people living in states with abortion bans.

The Emergency Medical Treatment and Labor Act (EMTALA) is a federal law that requires hospital emergency rooms that take Medicare funding to give stabilizing care — including abortion care when necessary — to anyone experiencing an emergency medical condition.
 
Idaho and other states with abortion bans want the power to ignore federal law and deny emergency abortion care to pregnant patients.
If the U.S. Supreme Court sides with Idaho, it will open the door for other states to ignore this nearly 40‑year‑old federal law and allow pregnant patients to suffer, or even die.
