This morning, SCOTUS released their opinion in U.S. Food and Drug Administration v. Alliance for Hippocratic Medicine, and in a unanimous decision, the Court declined to further restrict mifepristone. For now, access to medication abortion will remain unchanged.
It’s not often that we get to breathe a sigh of relief for abortion providers and pregnant patients, so today, we’ll take it. But this opinion does not guarantee anything in perpetuity – only that this particularly case was not successful in its attempt to attack abortion.
We have to be honest: the fact that this case even reached the Supreme Court shows just how dire our situation is.
Mifepristone is used in two-thirds of all abortions nationally. It’s incredibly safe, and it’s been on the market for decades. The fact that a Trump-appointed federal judge ruled to strip mifepristone of its FDA approval is unhinged, and it’s an indication of escalating attacks from every angle.
Nevertheless, we’re clear-eyed about what we’re up against. In recent weeks, we’ve seen renewed attacks on IVF and efforts in state legislatures to classify abortion medication as a “controlled substance.” Our work to elect pro-choice champions at the state and local level is absolutely critical to the future of reproductive rights.
