Corporate lobbyists and right-wing extremists manipulate the judicial system in their favor by carefully selecting courts and judges that align with their agenda. These groups have successfully undermined consumer protections, civil rights, reproductive healthcare, LGBTQ+ rights, and environmental regulations.
The Fifth Circuit, in particular, has become a breeding ground for right-wing judicial activism, with decisions that have had devastating consequences for millions of Americans.
The Judicial Conference recognized the need to address this issue and adopted a policy to promote random case assignments. However, due to pressure from Republican Senators, they backtracked and made the policy optional.
That’s why Senators Schumer, Hirono, and Whitehouse have introduced the End Judge Shopping Act, which would codify the Judicial Conference's policy of random case assignments into law.
