Representing the North Carolina NAACP, Free Speech For People, the Lawyers Committee for Civil Rights (LCCR), and pro bono co-counsel Sheppard Mullin filed a lawsuit today in Wake County Superior Court challenging the new ballot-marking machine that Mecklenburg County and several other North Carolina counties rushed to implement for the 2020 elections.

The suit alleges that the new ballot-marking machine, ExpressVote, which is manufactured by ES&S, poses serious risks to free and fair elections. It is insecure, vulnerable to hacking and malfunction, and tabulates votes from a barcode that cannot be read or verified by the voter. It is also a significant health risk due to the COVID-19 pandemic. Dozens or hundreds of voters will touch each machine; if the screen is not properly sanitized after each use, then the virus may be transmitted between voters via the machine's common surfaces. But the process of sanitization will delay voting, creating lines and delays that will force people to remain in public and in crowds, where the virus may transmit between voters.
