John, Last month, The New York Times reported that Justice Alito flew an upside-down American flag outside his house days before President Biden’s inauguration, a symbol of support for the January 6th insurrection and the “Stop the Steal” movement that spread the lie that Donald Trump won the 2020 presidential election. Then, two years later, the “Appeal to Heaven” flag carried by the violent mob at the Capitol on January 6th flew outside another one of Alito’s homes. The Appeal to Heaven flag is even worse for a Supreme Court justice to fly for one simple reason: as a symbol of Christian nationalism, it indicates a belief that the law of the land is not the Constitution, but the law of God as they interpret it. By flying both the upside-down American flag and the “Appeal to Heaven” flag on his properties, Justice Alito has exhibited clear partisan bias that makes him incapable of fair judgment in cases related to January 6th. Yet Alito has failed to recuse himself from these cases to date, including the ongoing case regarding whether Trump can claim absolute immunity from any crimes he committed while serving as President of the United States. Since Justice Alito will not recuse himself, it’s up to Congress to take action. Tell Congress: Impeach Justice Alito Now. Our judicial system includes a fundamental ethical standard that judges remain independent and unbiased in cases before them. This standard is not only an informal tradition but is also explicit in the new code of ethics recently adopted by the Supreme Court. Far from being an impartial jurist, Alito has shown explicit support for the “Stop the Steal” movement. Any political allegiances by a Supreme Court Justice are alarming, but especially an allegiance to a movement that has sought to undermine the foundations of our democracy. The code of ethics requires recusal, but Alito is not required to follow the code of ethics. The Supreme Court is facing a crisis of legitimacy, and our democracy cannot be placed in the hands of a Justice who supports those who want to destroy it.
