Dear Colleagues and Friends,
The leadership of Lawyers Defending American Democracy is united in its reverence for the law. Most share a background in the justice system in a variety of capacities. We are former judges, a state Attorney General, former prosecutors and administrative agency lawyers, and those who relied on the fairness of the system to bring justice to their clients.
We are passionate defenders of the rule of law and believe the essence of that rule is public trust and confidence in our justice system. When that is in question, we know it can bring the country to a dangerous place.
Yet that is what is happening in our Supreme Court, where two Justices stubbornly refuse to see that they should hold themselves to the same standards for recusal as every other federal judge in this country. Recently, we issued a call-to- action to Chief Justice Roberts asking that he intercede in seeking Justice Thomas’ recusal. More recently, revelations about Justice Alito have raised alarming concerns about his partisanship.
We invite you to read these recent articles by LDAD leaders about Justice Alito’s refusal to recuse himself, his distortion of history in a recent case, and how all this is impacting the Supreme Court:
Former Florida Supreme Court Chief Justice Peggy Quince and LDAD Executive Director Lauren Stiller Rikleen wrote for the xxxxxx: Recent Scandals Reveal Weakness of the New SCOTUS Code of Conduct [[link removed]]
LDAD Counsel Dennis Aftergut Wrote for the Verdict: Justice Alito’s Modified, Limited Hangout [[link removed]]
Walter J. White wrote for the Fulcrum: Justice Alito Doesn’t Understand the History of White Power [[link removed]]
We will continue to speak out about these issues and hope that other lawyers, the
media, and members of the public similarly express their concern that the erosion
of trust and confidence in this Supreme Court poses a growing crisis.
