Over the last few weeks, we’ve learned that Justice Samuel Alito flew a flag in his yard that had been carried by January 6th rioters and associated with the “Stop the Steal” insurrection movement. Then we found out that he flew another flag associated with “Stop the Steal” at his other house.
Flying a flag carried at the insurrection in the days immediately following the insurrection is tremendously alarming. Doing it again – years later and on multiple occasions, as even more high stakes insurrection-related cases came before the Court, simply cannot be explained away.
Alito has blamed his wife for flying the flags. But that does not address the ethics issues at play. He has a duty not just to BE impartial, but also to APPEAR impartial.
As we explained in The Hill, he can blame his wife all he wants, but he still needs to recuse himself from any and all cases related to the January 6th insurrection. Since he’s said he won’t, it’s up to Chief Justice Roberts to intervene.
Federal judges legally must recuse themselves if their impartiality can reasonably be questioned. At this point it is difficult to make any reasonable case for Alito’s impartiality; it can and must be questioned.
John, here’s the bottom line: Alito should NOT be allowed to rule without consequence on January 6th cases and other cases related to the 2020 election.
That’s why we’re hoping that we can get 1,000 signatures to our petition before midnight tonight demanding Justices Alito recuse himself from all Supreme Court cases related to the January 6th insurrection and the 2020 election.
