Just days before the Supreme Court is set to hear cases about the 2020 election and the January 6th insurrection, here's where things stand with Justice Samuel Alito. You’ve probably seen the news that Alito flew an upside-down American flag – a symbol adopted by Trump supporters who falsely claimed the 2020 election was stolen – at his home while the Court was considering an election case in 2021.
This comes on the heels of the never ending cycle of ethical violations at the Court, with our justices refusing to disclose their entanglements with political donors with business before the Court.

I don’t know about you, but I was raised to treat the flag with respect, not as a symbol of politics. And especially not as a sign of support for overthrowing our democracy.
Sure, everyone has a First Amendment right to expression, but judges are expected to meet a higher standard. Justice Alito should recuse himself from court cases relating to January 6th. My bill would require justices to disclose when they have a connection to an amicus before the Court (which clearly Alito does) and require them to explain their recusal decisions to the public.
But here we are, a justice showing bias on a matter before the Court and refusing to recuse. No wonder public trust in the Court is plummeting.
