• The Biden-Harris administration has strengthened health coverage protections for LGBTQ+ individuals. On April 26, the U.S. Department of Health and Human Services (HHS) Office for Civil Rights (OCR) and the Centers for Medicare & Medicaid Services (CMS) issued a final rule under Section 1557 of the Affordable Care Act (ACA) that includes important protections for LGTBQI+ people and other marginalized communities against discrimination in health care. The final rule ensures that health programs or activities that receive federal funds cannot discriminate based on sexual orientation, gender identity, or sex assigned at birth. The rule also strengthens protections for individuals who are pregnant, have disabilities, or who don’t speak English as their primary language.
