Given that he refuses to recuse himself from Donald Trump-related cases, Justice Samuel Alito should be impeached. The reasons are really quite straightforward.
According to the Supreme Court’s new (even if completely non-binding) code of ethics, “A Justice should disqualify himself or herself in a proceeding in which the Justice’s impartiality might reasonably be questioned.”
Can Alito’s impartiality reasonably be questioned in current cases coming before the Court involving Trump and the January 6th insurrection? New information tells us, it certainly can.
First, in January 2021, between the violent assault on the Capitol and the inauguration of President Biden, we learn that outside his house flew an upside down American flag, as carried by the insurrectionists who breached the Capitol.
Now we learn that two years later, another flag flew at another one of Alito’s homes. Like the inverted US flag, this one, known as the “Appeal to Heaven” flag, was also carried by the violent mob at the Capitol on January 6th.
If Alito would recuse himself from cases related to January 6th, the 2020 election, or Donald Trump, this wouldn't be necessary. But he won't, so Congress must act. Sign and send a direct message to your U.S. Representative and Senators demanding that Justice Samuel Alito face impeachment now.
The "Appeal to Heaven" flag is even worse for a Supreme Court justice to fly for one simple reason: As a symbol of Christian nationalism, it indicates a belief that the law of the land is not the Constitution, but the law of God as they interpret it.
Now the Supreme Court is considering cases related to January 6th, including whether President Trump should be immune from prosecution for his actions that day.
How can Alito pretend to judge these questions fairly? He cannot.
Far from being an impartial jurist, Alito has shown flagrant support of Trump’s cynically named efforts to “Stop the Steal”.
The code of ethics requires recusal, but Alito is not required to follow the code of ethics.
If Alito would recuse himself from cases related to January 6th, the 2020 election, or Donald Trump, this wouldn't be necessary. But he won't, so Congress must act.
