Last weekend, we learned about the upside-down American flag that flew in front of Supreme Court Justice Samuel Alito’s house after the January 6 attack on the U.S. Capitol.
Then, on Wednesday, news broke about another pro-insurrection flag that flew over Justice Alito’s vacation home in New Jersey, confirming that this was no one-time error in judgment.
Justice Alito has shattered any remaining credibility that he may have had as a trustworthy, impartial justice of the Supreme Court. To preserve the integrity of the Supreme Court, he must recuse himself from all cases related to January 6, especially the vote on Donald Trump’s claim of total presidential immunity for crimes committed while in office.
Unfortunately, the major news outlets are doing an absolutely awful job covering this story, treating it as just another partisan controversy rather than the fundamental threat to American democracy that it is.

When news first broke about Justice Alito's upside-down, pro-insurrection flag, he claimed, implausibly, that his wife put up the flag and he had nothing to do with it.
But as the old saying goes, “Fool me once, shame on you. Fool me twice, shame on me.”
Flying these treasonous flags aren’t just unseemly breaches of judicial decorum. They are flagrant violations of the Supreme Court’s own newly adopted code of conduct, which compels justices to “act at all times in a manner that promotes public confidence in the integrity and impartiality of the judiciary.”
After all, the only real asset possessed by the Supreme Court is the trust of the American people in its judgment. Absent that trust, its opinions are purely political. And if the Court is purely political, why should the public defer to them?
That’s why the Supreme Court “code of conduct,” announced with great fanfare last November, stipulates that “a Justice should disqualify himself or herself in a proceeding in which the Justice’s impartiality might reasonably be questioned, that is, where an unbiased and reasonable person who is aware of all relevant circumstances would doubt that the Justice could fairly discharge his or her duties. Such instances include, but are not limited to, those in which: (a) The Justice has a personal bias or prejudice concerning a party.”
Hello? Does this remind you of anyone?!
If Justice Alito refuses to recuse himself from cases involving January 6, Congress should impeach and convict him of violating the basic tenets of impartial justice on which public trust for the high court is based.
And let’s be clear: This is not a partisan double-standard. If a justice appointed by a Democratic president expressed these kinds of treasonous views or biases, we’d call for them to recuse as well.
