whether Justice Alito's flag-flying shows that his "impartiality might
reasonably be questioned" or that he "has a personal bias or prejudice"
that demands his recusal from cases involving Trump and Jan 6.
A bombshell report by The New York Times shows that two years after an
upside-down American flag flew in front of Supreme Court Justice Samuel
Alito's Virginia home, an "Appeal to Heaven" flag flew outside his New
Jersey beach house.
This flag, like the inverted American flag, was carried by rioters at the
Capitol on Jan. 6 and, as reported by the Times, "is now a symbol of
support for former President Donald J. Trump, for a religious strand of
the 'Stop the Steal' campaign, and for a push to remake American
government in Christian terms."
Federal law says justices must recuse themselves from any case "in which
their impartiality might reasonably be questioned" or "where they have a
personal bias or prejudice." But Alito has refused to do this for two big
cases related to Trump and Jan 6. One of those cases could give Trump
complete immunity from prosecution.
Before news broke of Alito's second insurrectionist flag the head of the
Senate Judiciary Committee, Dick Durbin, told reporters that he won't
investigate the incident because he "doesn’t think there’s much to be
gained."
This Supreme Court could decide the 2024 election!
