An upside-down American flag flew in front of Alito's house before Biden's inauguration.

The New York Times reports that an upside-down American flag flew in front of Supreme Court Justice Samuel Alito's house days before President Biden's inauguration. The upside-down flag is a symbol adopted by Trump supporters and election deniers after Jan 6.

Federal law says justices must recuse themselves from any case "in which their impartiality might reasonably be questioned" or "where they have a personal bias or prejudice." Alito has refused to do this for two big cases related to Trump and Jan 6. One case could give Trump complete immunity from prosecution.

The head of the Senate Judiciary Committee, Dick Durbin, told reporters this week that he won't investigate the incident because he "[doesn’t] think there’s much to be gained."

John, this Supreme Court was already facing a legitimacy crisis. With the possibility that the Justices could decide the 2024 election, the American people deserve a full investigation of Justice Alito's flag-flying incident.
