In case you missed it, the New York Times released a bombshell report late last week: Supreme Court Justice Alito’s house was flying an upside down flag, a symbol commonly understood to be associated with the “Stop the Steal” movement, at the same time that the Court was considering a case challenging the results of the 2020 election.

John, this is the biggest Supreme Court ethics story since ProPublica reported on Justice Clarence Thomas's secret trips with Harlan Crow.

This revelation calls into question Alito’s impartiality in every case that has come before the Supreme Court about the 2020 election and the January 6th insurrection – including our 14th Amendment lawsuit to enforce Trump’s disqualification, which the Court heard in February.

We brought our lawsuit on behalf of Republicans and unaffiliated voters who bravely stood up for the Constitution. They knew they would face immense blowback, but they took the fight on because they believed that it was right for America.

They believed that in our legal system, everybody gets a fair hearing. And now, it turns out that at least one of the justices who heard this case seems to have been biased against them, and had publicly displayed a symbol that indicated alignment with Donald Trump’s false position that he had won the 2020 election.

For Supreme Court justices, avoiding even the appearance of bias is crucial — and required under federal law and the Court’s ethics code.

Alito never should have heard cases about the 2020 election results or Trump’s responsibility for the January 6th insurrection, and he certainly should never hear a case that touches on those issues again.

That’s why we called on Justice Alito to recuse himself from any cases pertaining to the January 6th insurrection or the 2020 election.

Alito has damaged his own credibility and the credibility of the Supreme Court. His actions are further proof that we need judicial ethics reform to restore credibility and public trust to our judiciary.

For years, CREW has been fighting for an enforceable, binding Code of Conduct for Supreme Court justices. We’ve testified before Congress about it, submitted testimony to the Senate Judiciary Committee and sent letters to the Chief Justice, all in an attempt to bring ethics reform to the highest court in the land.

That fight just got a whole lot more urgent.
