Dear Friend,


As you may know, President Biden announced ([link removed]) his intention to reschedule marijuana from Schedule I to Schedule III. Given his own campaign statements, we fully anticipated this development, even if it is counter to fifty years of science and precedent. ([link removed])


Many of you have reached out to us or members of our team asking what you can do. We know you have questions and are ready to act, so we want to give you a rundown of we’re doing, and how you can help.


First and foremost, this decision is not a foregone conclusion. DEA said in the proposed rule: ([link removed]) “DEA has not yet made a determination as to its views of the appropriate schedule for marijuana.” Not only that, DEA’s argument is crafted in a way that indicates they see the rationale for rescheduling as largely lacking a strong basis.


This is unprecedented on every level. Far from losing hope, our sense is there is a real chance for victory. Now is the time step up every effort!

Next, we are working with an esteemed law firm specializing in administrative law to craft the strongest challenge possible. The rule will be officially published on Tuesday, May 21 and the 60-day comment period will officially begin then and end at some point in July. We will give you details on what comments will be most effective, so please bear with us while we evaluate the best path forward. We will provide a link and information to comment as soon as possible. This is a long game and we will have one shot to present our best arguments.


It is better to put forth the strongest possible comment than to submit something quickly, so we do not anticipate having final guidance for you by Tuesday. But we are working overtime to equip you as soon as possible and hope to have it soon after the 60-day period begins.


We cannot emphasize enough how much hope we have after reading the information from the DEA and DOJ. There are many irregularities in this entire procedure, and we intend to point those out as we give everything that we have to reverse this reckless proposal.


Please be patient with us while we work on our strategy. Our team, including the legal team, are working overtime to accomplish this! We cannot do any of this without your support.
