Statement of Attorney Fees

Recently, OAH received a suggestion to revise language on our Statement of Attorney Fees form. The new Statement of Attorney Fees form has been posted on the Forms page on our website. 

What changed

The updated form allows attorneys to provide more information regarding the type(s) of fees sought, including:

• Whether the amount of medical and rehabilitation benefits recovered are ascertainable for purposes of calculating contingency fees under Minn. Stat. § 176.081, subd. 1(a)(1); and
• When the amount of medical and rehabilitation benefits recovered are not ascertainable and a Roraff- or Heaton-type fee on an hourly basis is sought.

Additionally, the updated form more closely aligns with the form currently used by the Department of Labor and Industry.
