Rep. Mace Introduces Joint Resolution Opposing Biden's Obamacare Expansion for Illegal Aliens

(Washington, D.C., May 16th, 2024) — Representative Nancy Mace (SC-01) has introduced a joint resolution, backed by 29 cosponsors and 4 organizations, to express congressional disapproval of the Biden Administration's recent rule to extend Obamacare eligibility to over 100,000 DACA recipients by redefining "lawfully present." This rule is set to conveniently take effect shortly before the 2024 presidential election. Congress now has until November 1st to overturn the rule.


"Joe Biden, ‘Border Czar’ Kamala Harris, and impeached DHS Secretary Mayorkas flung our borders wide open, caused an invasion of our country by illegal aliens, and prioritized giving taxpayer benefits to illegal aliens over American citizens," said Rep. Nancy Mace. "This rule to give taxpayer-subsidized healthcare to 100,000 illegal aliens is yet another example of this administration putting America Last and actively incentivizing illegal immigration."


“Congressman Joe Wilson’s famous ‘You lie!’ line during an Obama State of the Union address was a bit early, but painfully accurate. Democrats always intended to provide unlawful amnesty recipients with taxpayer-subsidized Obamacare benefits. Desperate for political cover of late, President Biden has repeatedly signaled his intent to use his pen for an immigration executive action. But instead of acting to address the border crisis he created, he’s adding to magnets by giving illegal aliens health care. When Congresswoman Nancy Mace’s resolution is considered, the American people will see once again where Democrats’ priorities lie,” said RJ Hauman, president of the National Immigration Center for Enforcement (NICE).


"It's absolutely ridiculous the Biden administration wants to force American citizens to pay for healthcare for illegal immigrants when our veterans are doing without. This is why we have the worst illegal immigration we've ever faced before, because this president is magnetizing our border with promises of free healthcare and tons of other perks to people who dodge the legal system to get here. Rep. Harriet Hageman (WY-AL) said, “Once again, the Biden administration is abusing their authority and incentivizing even more illegal border crossings by redefining what ‘lawfully present’ means. Instead of providing healthcare and benefits, we should be deporting those that are here illegally and securing our borders. Sadly, the only way to change these open border policies is to change the president in November.”

“The Biden Administration’s final rule providing Obamacare subsidies to certain illegal aliens is another example of this Administration putting illegal immigrants before American taxpayers. When Obamacare became law, it specifically excluded anyone not in the country legally from being able to use taxpayer subsidies to access health insurance on the various state or federal exchanges. Though DACA wasn’t created until years after Obamacare, it’s clear to me that Congress never intended for illegal immigrants to be covered by any sort of deferred action or temporary relief program to receive taxpayer benefits. Asking Americans to pay $300 million a year for the health care of those who have broken the law is not only irresponsible, but it completely disregards the intent of the law,” said Rep.  “Under the Biden Administration, record numbers of illegal aliens are flooding across our borders, costing Americans at least $150.7 billion annually. With communities all over the country reeling from the financial burdens of the border crisis, the Biden rule to expand healthcare benefits to DACA recipients will place an even greater strain on American taxpayers. Expanding benefits eligibility to DACA recipients perpetuates an unlawful program, and will incentivize even more migrants to enter the country illegally. This resolution is an important step in holding the Biden Administration accountable for its complete disregard for our immigration laws, and its betrayal of hard-working American taxpayers,” said Joe Chatham, Director of Government Relations, Federation for American Immigration Reform.


“Americans have decided, in a pursuit of general welfare, to provide tax-backed public health coverage for citizen populations who are financially vulnerable, unable to work, or have toiled to reach retirement age. We should endeavor that public coverage defrays for only those vulnerable citizen populations; as well as steward hard-earned tax dollars in a sustainable manner so that these public coverage options may continue to exist for the use of tax-paying citizens who may find themselves in future need,” said Tanner Aliff, Director of Right on Health Care at the Texas Public Policy Foundation. “Expanding the definition of persons lawfully present for purposes of subsidized ACA Exchange Plan enrollment renders the concept of being an American citizen meaningless. Any action that twists public coverage eligibility to exclude citizenship not only jeopardizes the integrity of public coverage but threatens to spread resources thin and impose increasing regressive taxes on us all. Even for undocumented individuals twisting eligibility is a cheap concession that would perversely incentivize them to further avoid the process of becoming an American citizen and enjoy all the benefits it has to offer. Undocumented individuals often pay into a myriad of taxes with no benefit. Executive action extending public coverage may appear initially compassionate, but ultimately it is only a distraction further swaying illegal migrants from the real goal which should be becoming a legal citizen of the United States of America."


"DACA is, and remains, an unlawful amnesty program. Though it is revealing that the Biden Administration would feel the need to grant additional benefits to a population that had been pitched as the ‘best and brightest,’ we applaud Congresswoman Mace for taking a stand to stop those benefits,” said Grant Newman, Director of Federal Government Relations, NumbersUSA.


The resolution is a direct challenge to what Rep. Mace describes as “madness,” a policy that incentivizes illegal immigration in the midst of 9 million illegal crossings at the southern border, and a slap in the face of the American people already footing the bill for them. The rule requires approval from both the House and Senate and faces the significant challenge of needing a presidential signature or enough votes to override a veto.
