*Join us virtually for the May 2024 Environmental Quality Board meeting. At this meeting, the Board will hear:


* An update on plans for the 2024 Environmental Congress events.
* A report out on the status of the State Energy Policy and Conservation Quadrennial Report.
* An overview of how the Pollinator Action Framework is being implemented.
* Feedback and next steps on the Mandatory Categories Report.

*Opportunity for public comment on fish kills protocol*

The Minnesota Pollution Control Agency (MPCA) released a statewide, multi-agency protocol [ [link removed] ] that clearly shows how agencies work together when investigating fish kills in Minnesota. The new guidance includes investigation process, communications expectations, and strategies for reducing fish kills. The MPCA seeks public comment on this draft protocol.  In 2023, the Minnesota Legislature passed a law mandating the development of a fish kill response protocol. A fish kill is the unexpected, sudden death of large numbers of fish in a certain area. The fish kills addressed in the new protocol include those related to the discharge or runoff of pollutants from the land through incidents like toxic spills; runoff of manure, pesticides, or fertilizers; and high-temperature wastewater or stormwater discharges.  

The public comment period begins March 11 and ends May 10. Rich Valley East Industrial Development [ [link removed] ]

*Project description: *The AUAR study area encompasses an area totaling approximately 333 acres on 6 parcels located at County Road 42 and Emery Avenue E in the City of Rosemount, Dakota County, Minnesota. Project Mercury, LLC is proposing to develop the study area from existing farmland to data center or industrial, business park, and commercial uses. Two scenarios are proposed for evaluation in the AUAR. Scenario 1 includes multiple buildings for a total of 2.3 million square feet of proposed data center development. Scenario 2 includes multiple buildings for a total of 1,293,333 square feet of proposed light industrial, 646,667 square feet of business park, and 560,000 square feet of community commercial development. The proposed development within the AUAR study area is anticipated to begin in August 2024.

MnDOT US 52 PEL Study (SP 2506-86) - Opportunity to comment on the Final PEL Study Report

*Notice description: *The Minnesota Department of Transportation (MnDOT) initiated a Planning and Environmental Linkages (PEL) study for US Highway 52 (US 52) in March 2022. This PEL study focused on the segment of US 52 from Hader to Zumbrota, MN; an eight-mile length of rural roadway. The purpose of this PEL study is to provide a review of access concepts for consideration in a future environmental review process. The Purpose and Need/Evaluation Criteria and Concept Analysis Technical Memorandums were developed and made available for public comment in 2023 and early 2024. A summary of the study, recommendations, and an implementation plan are now available for public review in the final documentation for this study. The Final PEL Study Report is available for public comment. See link to additional information to access the document and submit comments. Printed copies of the document will be available at the Zumbrota and the Van Horn Public Libraries.

Fish kill reports

Minnesota Duty Officer reports pertaining to fish kills are summarized in the following table, in accordance with 103G.216, REPORTING FISH KILLS IN PUBLIC WATERS, Subd. 2 Reporting Requirement. These reports were received via the Minnesota Duty Officer prior to the submission deadline for this edition of the EQB Monitor. They represent the raw data/information provided by callers. For more information regarding fish kills in Minnesota see the Department of Natural Resources [ [link removed] ]. Call the Minnesota Duty Officer at 651‐649‐5451 or 800‐422‐0798 to report fish kills.
