*RELATING TO WATER RIGHTS*

IN THE MATTER OF the petition by HF Sinclair Parco Refining LLC for Exchange of Water Pursuant to Wyo. Statute ?41-3-106 for the diversion of out-of-priority water under the following appropriations of water from the North Platte River, for refinery, domestic, and/or municipal purposes in Carbon County Wyoming ?Refinery Water Rights?:


* The Producers and Refiners Corporation Appropriation, Permit No. 16528, Proof No. 17993, through the Producers and Refiners Corporation Refinery 8? Water Pipe Line, with priority of January 30, 1923;
* The Town of Sinclair Appropriation, Permit No. 7824, Proof No. 13235, through the North Platte Parco Water Pipeline, with priority of April 29, 1907;
* The Town of Sinclair Appropriation, Permit No. 17087, Proof No. 19489, through the North Platte Parco Water Pipeline, with priority of April 9, 1926;
* The Town of Sinclair Appropriation, Permit No. 17088, Proof No. 19490, through the North Platte Parco Water Pipeline, with priority of April 9, 1926;
* The Town of Sinclair Appropriation, Permit No. 17090, Proof No. 19492, through the North Platte Parco Water Pipeline, with priority of April 9, 1926.

In exchange for an equal amount of replacement water through forgone diversions under the following appropriations of water for irrigation purposes in Carbon County Wyoming ?ER Ranch Water Rights?:

Diverting from the Grand Encampment River:


* The Guy H. Nichols Appropriation, Territorial Proof No. 220, through the Nichols Ditch, with priority of Spring 1879;
* The William T. Peryam Appropriation, Territorial Proof No. 227, through the Peryam Ditch, with priority of July 10, 1886;
* The Ezra Nichols, Amos Baggott, Guy Nichols, and J.P. Culleton Appropriation, Territorial Proof No. 230, through the Grand Valley Ditch, with priority of May 13, 1887;
* The J.G. Dettinger Appropriation, Territorial Proof No. 4045, through the Wagoner Ditch, with priority of July 15, 1885;
* The W.T. Peryam Appropriation, Permit No. 1399, Proof No. 9515, through the Peryam No. 2 Ditch, with priority of December 23, 1896;
* The W.T. Peryam Appropriation, Permit No. 1400, Proof No. 3830, through the Mill Ditch, with priority of December 23, 1896;
* The Alice R. Peryam Appropriation, Permit No. 585 Enl., Proof No. 9516, through the Enl. Nichols and Peryam Ditch, with priority of August 14, 1900;
* The Aubry R. & Nina T. Huston and Nina H. Boykin Appropriation, Permit No. 5974 Enl., Proof No. 32065, through the Enl. Cherokee Ditch, with priority of June 29, 1959; and

Diverting from other sources:


* The D.T. Murray and Samuel Wagoner Appropriation, Permit No. 618, Proof No. 2409, diverting from Cotton Creek, through the Cotton Creek Ditch, with priority of November 28, 1893;
* The A.J. Chidester Appropriation, Permit No. 8363, Proof No. 9525, diverting from Badger Creek or City Gulch, through the Chidester Ditch, with priority of May 8, 1908;
* The J.M. Wombaker Appropriation, Permit No. 2576 Enl., Proof No. 13464, diverting from Cottonwood Creek, through the Enl. Rosander No. 2 Ditch, with priority of March 6, 1912;
* The John M. Wombaker Appropriation, Permit No. 3992 Enl., Proof No. 19042, diverting from the North Fork Grand Encampment River, through the Enl. Wolfard Canal, with priority of April 11, 1919.

If successful, this petition would allow continued diversion under the Refinery Water Rights while out of priority during an allocation priority call on the North Platte River in exchange for replacement water provided by stopping all irrigation diversion and beneficial use therefrom under the affected portions of the ER Ranch Water Rights beginning on April 1 and continuing through the end of any water year in which this exchange of water is implemented.? Said petition and map are on file with accompanying submissions at the State Engineer?s Office in Cheyenne (777-6202).

NOW THEREFORE, a public meeting shall be convened on _June 4, 2024 beginning at 3:00 P.M. at the Platte Valley Community Center in Saratoga, Wyoming_, at which time the State Engineer will accept public comment regarding the proposed exchange.? Written comments must be received or post-marked by June 14, 2024.
