Jack Smith is taking heat in his attempts to keep former President Donald Trump from returning to the White House.
On Tuesday Smith was reprimanded with a congressional ethics complaint, filed by Rep. Elise Stefanik (R-NY), accusing the Biden Justice Department special counsel of “trying to interfere with the 2024 election.” Smith has charged Trump in two federal cases, one related to the January 6th, 2021 Capitol riots and another involving the storage of classified documents at Mar-a-Lago. Both cases are essentially frozen while the U.S. Supreme Court considers Trump’s claims of presidential immunity.
“It’s obvious to any reasonable observer that Jack Smith is trying to interfere with the 2024 election and stop the American people from electing Donald Trump. At every turn, he has sought to accelerate his illegal prosecution of President Trump for the clear (if unstated) purpose of trying him before the November election,” Rep. Stefanik wrote on X. “The Justice Department’s own policies clearly prohibit Smith from doing so, and as a DOJ employee he is bound by those policies. Moreover, when the District Court imposed a stay on the proceedings, Smith and his office ignored it and continued to file discovery documents. Smith’s conduct has brought disrepute to the Department of Justice and the entire federal government, and the DOJ’s Office of Professional Responsibility should impose the discipline that such conduct warrants.”

She added: “Jack Smith’s multiple attempts to rush to trial the federal January 6th case against President Trump violated long-standing, explicit Justice Department policy. Further, Jack Smith’s repeated violations of the United States District Court for the District of Columbia’s stay of proceedings are a lawless breach of trial ethics and lawyerly conduct. Jack Smith’s actions brought disrepute to the Justice Department and the federal government as a whole, and he should face discipline appropriately.”
The charge that Smith is engaged in election interference is ironic, given that President Trump has been identified by his foes as the ultimate interferer of federal elections and the bedrock of democracy. Among Smith’s transgressions, the Republican lawmaker claims, are unlawful attempts to expedite Trump’s trial in violation of DOJ policies and violating a court-ordered stay on evidence discovery. Smith has said publicly that he may circumvent a decision by the Supreme Court if it rules that Trump is wholly or partially immune from charges.
Stefanik’s letter now heads to the Justice Department’s Office of Professional Responsibility, which was established in the wake of the 1972 Watergate scandal to rein in federal prosecutors skirting the bounds of laws. Smith’s office has not commented on the letter, according to the New York Post [ [link removed] ], and it’s unexpected that the DOJ will comment on any active personnel investigation.
The New York congresswoman rose to prominence last year for taking on Ivy League presidents she accused of failing to stem a rise in antisemitism on campus resulting from pro-Palestinian protests. Her high-profile congressional hearings forced the resignations of the presidents of Harvard and the University of Pennsylvania after both received sharp criticism for failing to agree with Stefanik that calls for the elimination of the Jewish nation of Israel are antisemitic. She is believed to be on the short list of vice presidential candidates [ [link removed] ] under consideration by former President Donald Trump [ [link removed] ].
