S 971 is a bill termed the Due Process Continuity of Care Act and seeks to revise Title XIX of the Social Security Act. It intends to eliminate the exclusion of Medicaid coverage for inmates who are awaiting disposition of charges. Upon its implementation, the benefits will commence on the first day of the first calendar quarter which commences no earlier than 60 days after the enactment of the act, and it would apply to all services provided from said date forth. 

The bill also commissions the Secretary to provide planning grants to states to assist in delivering medical aid under the state Medicaid program to individuals tallied as a result of this amendment. The grants would be put to use in creating an application that meets the criteria outlined in the bill. This application process involves an examination of state policies as they relate to this specific patient population, and developing a plan to maintain and increase the number of health care providers who can extend treatment to this population, notably covering physical and behavioral health treatments.
