Dear John,

The Constitution protects certain rights of individuals both accused and convicted of crimes. One of these protections is against The term "cruel and unusual" punishment. But how do we define the term?


The Supreme Court is currently considering the Eighth Amendment question of do fines and jail time for sleeping in public spaces constitute 'cruel and unusual' punishment? Through our lesson, students will examine the history of the Eighth Amendment and articles related to the Supreme Court case.
