Proposed Rulemaking

Cross-Program Payment Allocation

Stakeholders and Interested Parties,

Employment Security Department currently runs three programs; State Unemployment Insurance, WA Cares, and Paid Family and Medical Leave.  As part of its duties, the Department receives payments from employers for each program. Occasionally, a payment is sent to the Department that does not indicate what program(s) the payment was intended for, and the Department may be unable to reach the employer for clarification. There are currently no rules addressing how employer payments are allocated across programs in these rare situations. Therefore, Employment Security Department is engaging in rulemaking to add rules that will address how payments will be allocated across programs.

We have now filed a proposed rule making and have proposed rule language to share.

If you would like to submit written comments on the rulemaking, please identify the rulemaking as "Cross-Program Payment Allocation" and send them by June 25, 2024, to [email protected] or to:
