The Biden Administration Rolls Out Title IX Rules: The Biden administration released final Title IX regulations last Friday that seek to redefine “sex” in favor of “gender identity,” eviscerate due process rights, and curtail freedom of speech. Among the 1,577 pages of regulations under the powerful Title IX law—which governs all educational institutions that accept federal funds, from kindergarten through university—are provisions that endanger women's opportunities, privacy, and safety. 
  • First, the regulations claim that it "harms" and discriminates against students to treat them as their biological sex, which gives males identifying as women the "right" to invade women's bathrooms, locker rooms, and sports rosters.
  • Second, the regulations strip basic due process protections for students accused of sexual misconduct—rights that federal courts have upheld hundreds of times.
  • Third, the regulations provide a vague definition of "harassment" that eats into First Amendment-protected speech, including the right to use biologically accurate pronouns for fellow students. 
Title IX is a statute intended to protect women's educational opportunities, and unelected bureaucrats have now turned it into a weapon against women's rights, and additionally to defy Supreme Court precedent when it comes to due process and free speech. Today, as we approach the 52nd anniversary of the landmark anti-discrimination law, women’s athletic opportunities are under attack. Biden's Omnibus Title IX Rule goes into effect August 1 and will require schools to allow trans athletes to compete on teams that align with their gender identity, unless the school can demonstrate that allowing males who identify as women onto women’s teams would undermine "fairness in competition" or "safety." During April—which is officially Earth Month and includes Earth Day celebrated on the 22nd—the rhetoric surrounding the state of our climate can swing dramatically.
