Elective procedure, essential fight
(World Magazine) Steve Aden, chief legal officer for Americans United for Life, said the 5th Circuit Court is likely to uphold Texas’ right to shutter abortion facilities during the pandemic. He also expects the conservative-majority 6th Circuit Court to do likewise in the Ohio case: “Ultimately, the abortion industry faces an uphill fight.” As Texas officials told the 5th Circuit Court, the COVID-19 pandemic is America’s greatest health crisis in 100 years and puts the state at the “apex of its constitutional authority,” said Aden, which means abortion facilities have little chance of getting special treatment in conservative states.  Planned Parenthood only does elective procedures. “They’re being duplicitous,” said Aden. “They’re claiming that it’s a necessary health service, but on the other hand they’re trying to hide the fact that they only do elective, purely voluntary, abortions.”

(LA Times) Steve H. Aden, chief legal officer and general counsel at Americans United for Life, which opposes abortion, anticipates the court would allow the state orders to remain in place because the country is fighting a pandemic. “The power of the state to take extreme measures to deal with a health crisis like this is really the apex of its constitutional powers,” he said, citing a 1905 precedent that let states fine or imprison citizens who did not get a small pox vaccine during an epidemic of the disease. “There really isn’t much that a state cannot do to respond to what is truly a health emergency.”

We Need to Re-Learn Civility
(AUL) It has become cliché to point to some political move you disagree with and exclaim, “the founding fathers would be rolling in their graves!” The triteness is especially acute as it relates to how we project our politics onto those who came before us. We have a strong inclination to frame Americans of the past, particularly from the founding generation, in angelic terms.
