Tomorrow the Supreme Court is hearing Donald Trump's claim of presidential immunity from prosecution on charges related to his efforts to overturn his 2020 election loss.

Trump’s attempts to claim absolute immunity do not hold up to even the barest scrutiny — but they are still dangerous. If the Supreme Court drags its feet, or worse, declares that former presidents have total immunity, that could fatally undermine efforts toward accountability, more broadly weaken our whole democratic system of checks and balances, and could lead to even more of Trump’s lawbreaking and lies.

We need to send the Supreme Court a message: they must reject Donald Trump's dangerous claim of immunity.

Jack Smith’s indictment of Trump for his efforts to overturn the 2020 election was — and remains — one of the most significant steps toward accountability for Trump. Of course, Trump has been trying just about any claim to try to get out of facing trial for those charges, including belatedly claiming that Jack Smith’s appointment was illegitimate. These claims are nonsense. That’s why CREW filed an amicus brief strongly opposing Trump's arguments and his bid for total immunity.

Giving Trump immunity would mean giving him a dangerous pass from being held accountable for his years-long assault on our democracy, including breaking his oath of office and threatening the peaceful transfer of power.

We can’t overstate how dangerous the consequences would be if the Supreme Court decides to side with Trump and give presidents total immunity from following the law.

We’re doing everything in our power to persuade the Supreme Court that they must reject Trump’s immunity claims, and do so quickly and completely.
