Former President Donald Trump is facing 34 felony counts related to alleged falsification of business records linked to payments made to adult film actress Stormy Daniels during the 2016 presidential campaign. CNN legal expert Arthur Aidala has raised concerns about a potential flaw in the prosecution’s evidence—namely, the absence of Trump’s signature on crucial documents.
Aidala, a criminal defense attorney known for representing high-profile figures such as Harvey Weinstein and Rudy Giuliani, highlighted the absence of Trump’s signature on key documents, which he believes could weaken Manhattan District Attorney Alvin Bragg’s case. Speaking on CNN, Aidala expressed skepticism about the reliability of the prosecution’s witnesses, particularly Michael Cohen and Stormy Daniels. He suggested that the defense might seek to undermine their testimonies to bolster their case.
Aidala also emphasized the importance of judicial instructions to the jury, indicating that the defense could use them to sway the jury's opinion. He hinted at a tactical focus on securing a hung jury rather than an outright acquittal, aiming to plant enough doubt among jurors to prevent a unanimous verdict.
During jury selection, concerns were raised about the impartiality of some jurors, further complicating the trial proceedings. Aidala noted that while there is paperwork corroborating the prosecution's evidence, it lacks Trump’s handwriting or signature, except for a check. This gap in documentation might be exploited by the defense to argue that Cohen acted independently.
With the absence of Trump’s signature on critical documents, the defense is poised to challenge the prosecution’s ability to establish guilt beyond a reasonable doubt, potentially influencing the trial’s outcome.
Meanwhile, Trump has questioned the fairness of the trial in Manhattan, targeting the daughter of Judge Merchan, a Democrat operative. His allies in the media have criticized DA Bragg’s decision to levy felony charges against Trump while historically downgrading felonies against other defendants.
Ahead of the trial, Trump took to Truth Social to express frustration over restrictions preventing his supporters from accessing the courthouse, contrasting it with what he perceives as leniency towards pro-Palestinian protestors.
