But I can tell you one thing that all three of those presidents agreed on… in
fact,all 7 most recent presidential administrations, from Reagan in 1987 to
Biden in 2023 agree on one issue.




Certificate-of-Need (CON) laws are BAD for health care.

These unnecessary, harmful laws require hospital systems and other health
facilities to get approval from a government agency before they can open or
expand their facilities in a given area.

Often, just adding a single new bed or MRI machine requires government
approval,a process that can add years and tens of thousands of dollars in costs.

In truth, CON laws are never needed and would be viewed as unacceptable in any
other market.

These protectionist laws often give entrenched existing facilities veto power
over competitors that might want to come into their area.This anti-competitive
behavior restricts patients’ options and keeps costs high.

State and local “certificate of need” or CON laws are well-named: they’re the
biggest “con” in American health care.

When 7 successive presidential administrations agree, you know it must be
terrible.

Sadly, more than half the states currently have a CON law on the books.

All Certificate of Need laws should be repealed to boost competition and
reduce costs for patients.

That’s why state-level repeal of CON laws is a key part of our Personal Option
plan for health care.
