The Supreme Court is supposed to be fair and independent. Yet, we grapple with a far-right Court that continues to weaponize partisanship and strip away our rights, including reproductive freedom and voting rights.
Currently, sitting justices serve for life and vacancies can occur at any time. This randomness is why one-term Donald Trump was able to appoint more justices than either of the two-term presidents that came before him. The result? A Court wildly out-of-touch with the values of the American people with members that may serve for decades.
The United States is the only major constitutional democracy in the world that doesn’t have term limits for our top justices. 49 of 50 American states impose term limits, elections, or mandatory retirement ages on high court judges–but not our highest court in the land.
We can fix this with much needed reforms, starting with term limits. The Supreme Court Tenure Establishment and Retirement Modernization (TERM) Act of 2023 has been introduced in Congress. The TERM Act would introduce fixed 18-year terms for current and future Supreme Court justices and establish regular nominations of justices in the first and third years of each presidential term–a necessary, fair, and accountable reform to the judicial system.
