Topic: *Adoption (CR-103) ? Safety Standards for Firefighters*
Brief Description: The purpose of this rulemaking is to update chapter 296-305 WAC, Safety standards for firefighters. Labor & Industries received a petition requesting L&I engage in rulemaking to update the language in WAC 296-305-03002, Hazardous materials. There have been many technological advances in the years since this WAC code was written, including in personal protective equipment (PPE) materials, certification and testing. The adopted rule updates the required standards for hazardous materials protective equipment. The current rule requires compliance with the following National Fire Protection Association (NFPA) standards for hazard material protective equipment: NFPA 1991 (2000 edition), NFPA 1992 (2000 edition) and NFPA 1994 (2001 edition). The adopted rule updates the requirements to the NFPA 1990 (2022 edition), which is a consolidation of the currently referenced NFPA standards and the current edition. As requested in the petition, the adopted rule allows an exemption from the requirement that protective ensembles and liquid splash-protective ensembles completely cover the wearer?s respiratory protection when respiratory protection meets the National Institute for Occupational Safety and Health (NIOSH) chemical, biological, radiological, and nuclear (CBRN) self-contained breathing apparatus (SCBA) testing.
WAC 296-305-04001, Respiratory equipment protection, which has guidance for breathing air quality for firefighters was also updated. The reference to ANSI/CGA G6-1, Commodity Specification for Air, needed to be updated to fix a typo in the standard number.

Brief Description:?The purpose of this rulemaking is to update Administrative Rules under Chapter 296-900 WAC regarding how certain penalties are calculated in order to make penalties more effective and address concerns raised through the Occupational Safety and Health Administration (OSHA) State Activities Mandated Measures (SAMM) report that Washington penalties continue to be below the national average. OSHA uses the SAMM report to determine whether State Plans are as effective as OSHA. Changes considered under this rulemaking include adding inflation adjustments to the penalty calculations.
In addition, state-initiated amendments will also be proposed to address other areas and make housekeeping updates in chapter 296-900 WAC relating to penalties and appeals.

Brief Description: The purpose of the continuance is to extend the public comment period and provide a second public hearing for changes under chapter 296-104 WAC, Board of Boiler Rules ? Substantive. L&I filed a CR-102 Proposal on January 2, 2024 (WSR 24-02-070 [ [link removed] ]). A hybrid public hearing was held on February 21, 2024, with written comments accepted through February 13, 2024. During the process, some stakeholders did not receive notice of the CR-102 filing. This continuance extends the opportunity for public comments.
The Board of Boiler Rules and Department of Labor & Industries proposed amendments to the boiler rule. The changes affect safety codes, installer and clearance requirements, and fees for boilers and pressure vessels. The amendments are needed to ensure the rule is consistent with national boiler and unfired pressure vessel safety standards and industry practice.
