States are suspending Certificate of Need laws in the wake of COVID-19, but the damage might already be done

With the spread of COVID-19 pushing hospitals to full or near-full capacity from California to New York to Florida, a handful of states are reevaluating their Certificate of Need (CON) laws that prevent the growth of health care services and facilities.

CON laws currently exist in 36 states across the country, requiring health care providers to prove their need before they’re allowed to open or expand. Angela Erickson tells us which of these states have suspended some portions of their CON laws and why they should remain off the books for good.
