We just filed an amicus brief urging the Supreme Court to dismiss Donald Trump’s arguments for immunity and affirm that presidents are NOT above the law.
Our argument is technical, and it targets Trump’s complaint that Attorney General Merrick Garland did not have the legal authority to appoint Special Counsel Jack Smith. But Trump did not challenge the validity of Smith’s appointment at the lower court level—so he cannot challenge it now, and even if he could, Garland did have the power to appoint Smith.
Trump is simply throwing out any excuse to dismiss the case, and hoping it will find a friendly audience. That’s all this new argument taking issue with Jack Smith’s appointment is about.
Donald Trump has used similar delay tactics over and over again in lawsuits and indictments against him. These tactics cannot be allowed to work in this critical case.
Jack Smith’s indictment of Trump for his efforts to overturn the 2020 election was—and remains—one of the most significant measures of accountability for Trump.
Now, Trump is trying to get out of facing trial for his election interference by claiming that presidents are above the law. The Supreme Court will hear his claim to "total immunity" on April 25th.
Our democracy is stronger because Trump faced appropriate charges related to the January 6th insurrection.
The Court should have rejected Trump’s request to hear the case out of hand. Donald Trump’s attempts to claim absolute immunity do not hold up to even the barest scrutiny—but they are still dangerous.
We do not live in a nation of kings. The Supreme Court must now affirm that fact.
