Tell Congress to Rein in the Supreme Court

The Supreme Court just heard arguments in two key cases that threaten the EPA's and other agencies' ability to protect the people from big business.

Friend - the Supreme Court just heard arguments in two critical cases - Relentless, Inc. v. Department of Commerce and Loper Bright Enterprises v. Raimondo - that could gut the federal government's authority to enforce even the most basic environmental protections.

In both cases, corporate interests backed by big oil are suing in order to hamstring federal agencies' authority to protect people from powerful special interests. If these plaintiffs get their way, it would move authority over every area of public policy from public-interest agencies like the EPA to the MAGA-dominated federal courts.

In the last two years, extremist Justices on the Supreme Court have already severely limited the federal government's ability to regulate climate pollution from power plants, stripped Clean Water Act protections from most of the wetlands in the United States, and overturned Roe v. Wade. Some even take lavish gifts like private jet flights from the same billionaires bringing cases like this for them to rule on. Now, they're looking to overturn a bedrock doctrine of the American legal system in order to increase their own power.

These critical cases target what's called the Chevron Doctrine. This longstanding Supreme Court precedent says that when something is unclear in a federal law administered by an expert agency, such as the way the EPA administers the Clean Air Act, federal courts should defer to agency experts' reasonable interpretations of what the law means. The Chevron Doctrine is critical to enforcing the laws that protect our environment and our communities from pollution and other harms. It touches every issue, from climate to democracy to healthcare, reproductive rights, consumer protection, workers' rights, student debt, and so much more.

Put simply, if the Supreme Court rules in favor of the plaintiffs in Relentless and Loper Bright, it will gut the ability of federal agencies like the EPA to implement the laws Congress passes, transferring that power to unelected right-wing judges. And if Congress doesn't act, far-right judges will keep control of our Supreme Court, and keep rolling back our rights, for decades to come.

Congress must stop this MAGA power grab. We need lawmakers to pass the Judiciary Act to expand and rebalance the Supreme Court. They must also pass the Supreme Court Ethics, Recusal, and Transparency (SCERT) Act to ensure our nation's highest court doesn't have the lowest ethical standards. And we need the Senate to prioritize confirming President Biden's pro-environment, pro-democracy judicial nominees to every vacancy on the federal bench.
