TDI adopts a rule to update notice requirements and set parameters relating to nonrenewal of uncooperative insureds
The Texas Department of Insurance (TDI) adopts a rule to implement:
* SB 1602, 87th Legislature, 2021, which requires insurers to nonrenew private passenger automobile policies if an insured fails or refuses to cooperate in an insurer?s investigation, settlement, or defense of a claim or action;
* HB 1900, 88th Legislature, 2023, which updates the timing of notice for nonrenewal and cancellation of certain property and casualty policies; and
* HB 2065, 88th Legislature, 2023, which clarifies that insurers may not renew the policy if any insured?not just a named insured?fails or refuses to cooperate and also clarifies that Insurance Code ?551.1053 applies only to third-party liability claims or actions.
