Trump v. Anderson, the case that CREW brought to the Supreme Court about Trump’s disqualification from the ballot, is proof positive that the Supreme Court can act rapidly to resolve important cases.
But that’s a stark contrast to what the Court is doing in Trump’s immunity case.
The Supreme Court is keeping Trump's federal election interference trial frozen while it considers Trump’s claim to "total immunity" from prosecution for any acts during his presidency.
The trial was originally set to begin March 4, but now, the Supreme Court won’t even hear the case until late April.
John, this is yet another effort by Donald Trump to claim that he is above the law and evade accountability. And the Supreme Court is giving him the delay he wanted.

Instead, the Court ordered special counsel Jack Smith to argue why the D.C. Circuit’s decision should go into effect while the Court considered whether to take the case.
Smith did, urging the Court to let stand the lower court ruling that denied former Trump immunity from prosecution, allowing the trial to begin quickly. As Smith wrote, “the public interest in a prompt trial is at its zenith where, as here, a former President is charged with conspiring to subvert the electoral process so that he could remain in office.”
But instead of letting stand the denial of immunity and allowing Smith’s case to move forward, the Supreme Court decided to take up the case, giving Trump the time he wanted. They aren’t even hearing the case until late April, pushing a decision back weeks or months after that.
Trump got what he wanted. If he can delay this case long enough, and if he wins the presidency, Trump could order the Justice Department to drop the criminal case – and continue to evade accountability for January 6th.
Donald Trump’s attempts to claim absolute immunity do not hold up to even the barest scrutiny — but they are still dangerous. We do not live in a nation of kings. The Court needs to move quickly to affirm that fact.
