FSC Statement On Fifth Circuit Court Of Appeals In Texas Age Verification Challenge
The Fifth Circuit Court of Appeals issued a mixed opinion in Free Speech Coalition v. Paxton, upholding a preliminary injunction against mandated health warnings on adult websites but lifting the injunction against the state's age verification mandate. However, platforms without age verification measures remain at risk of prosecution by the Attorney General. FSC disagrees with the majority's analysis, citing violations of Supreme Court precedent and concerns about privacy and free speech.
