A critical battle is unfolding in the Supreme Court that could dramatically impact our ability to fight climate change and protect our environment. Recently, the Justices heard oral arguments in a case that could overrule 40 years of precedent set in Chevron v. Natural Resources Defense Council which allowed agency experts to have a major role in interpreting climate laws.
During oral arguments, Justices Elena Kagan and Sonia Sotomayor emerged as crucial defenders of the Chevron doctrine - emphasizing the essential role of these agency experts in interpreting complex environmental statutes, rather than the Supreme Court themselves.
This might sound like a complex legal issue, but it’s actually very simple: it’s about ensuring our federal environmental laws are interpreted and carried out by experts, reflecting the most up-to-date science. We’re talking biologists, economists, geologists, chemists, engineers, and on and on and on.
By seeking to overturn the Chevron doctrine, the extreme conservative majority wants to make judges (in other words: THEMSELVES) the sole arbiter of these issues. The potential rollback of the Chevron doctrine threatens to undermine decades of progress in our fight against climate change and pollution.
As supporters of science-based environmental policy, we must make our voices heard and rally behind Justices Kagan and Sotomayor. Our petition sends a clear message: we value scientific insight and reasoned judgment in guiding our environmental laws.
