Robert F. Kennedy, Jr., presidential candidate and conspiracy theory superspreader, could soon be handed a big win from the right-wing Supreme Court.
This week, the Supreme Court is hearing a major case to decide whether or not the federal government can regulate misinformation on social media.
Conservatives and conspiracy theorists like RFK are teaming up to make an absurd free-speech argument, claiming they can post whatever they want on social media, regardless of the consequences to our democracy.
The motivation for the lawsuit might be in bad faith, but since Donald Trump packed the court, we’ve seen right-wing justices side with conservative causes again and again.

So, what’s going on with the Supreme Court? And what does it have to do with RFK?
Since 2021, the Biden administration has worked directly with social media companies like Facebook to try and stop conspiracy theories and misinformation from spreading.
In one example, RFK Jr. tweeted without evidence that baseball legend Hank Aaron died as a result of the COVID-19 vaccine. The Biden administration asked Twitter to remove the post because it endangered public health.
Ultimately, Twitter agreed with the administration and suspended RFK’s account. RFK sued and later won an injunction against the administration, though that decision is now stayed as we await the Supreme Court’s decision.
Of course, regulating conspiracy theories isn’t only essential to protecting public health, it’s also critical to protecting our democracy from the election lies that spread in 2016 and 2020.
Those lies helped Donald Trump win in 2016, and they helped him spread the “big lie” in 2020 that led to the January 6th insurrection.
So the bad news is that Trump and MAGA Republicans are already planting the seeds that Democrats will steal the election. If the Supreme Court sides with the right-wing argument, bad actors online will have an unfettered ability to continue to spread lies.
