[link removed] [[link removed]] Hey John, it’s Noah Bookbinder here, president of CREW. I’m inviting you to join a briefing call this Thursday [[link removed]] , but first I wanted to make sure you’re up to date on our recent work:
Just this month, there have been two major developments in our work to pursue accountability for the January 6th insurrection. As you likely know, a few weeks ago the Supreme Court overturned the Colorado Supreme Court’s decision barring Donald Trump from the state’s primary ballot for engaging in insurrection, finding that states can only enforce Section 3 of the 14th Amendment against a presidential candidate if Congress legislates first.
But importantly, the Court did not exonerate Trump of insurrection--and 3 members of the Court called Trump an “oathbreaking insurrectionist.”
Now it is up to the states to fulfill their duty under Section 3 to remove from office anyone who broke their oath by participating in the January 6th insurrection.
Then just yesterday, the Court rejected Couy Griffin’s bid to overturn his 2022 removal from a county commission in New Mexico under Section 3, following a case CREW brought. This rejection by the Court means Griffin’s disqualification stands, and reaffirms that states may enforce Section 3 for state officials, which is a crucial mechanism for accountability.
What does this all mean for the future of accountability for the insurrection? What’s next for CREW’s work on the 14th Amendment? Will Congress act?
