BREAKING: We just filed a lawsuit on behalf of The League of Women Voters of the United States (LWV-US), the League of Women Voters of New Hampshire (LWV-NH), and several individual New Hampshire voters in the U.S. District Court of New Hampshire against Steve Kramer, Lingo Telecom, and Life Corporation, who together subjected New Hampshire residents to robocalls that deepfaked President Biden’s voice to prevent them from voting in the New Hampshire presidential primary in January. We seek to stop the defendants from using robocall and AI technology to intimidate, threaten, coerce, or deceive voters. Our lawsuit asks the court for an injunction to stop the defendants from producing, generating, or distributing AI-generated robocalls that impersonate U.S. politicians or deceive recipients about who is making or funding the communications.

In the days leading up to the New Hampshire primary, Defendants orchestrated and disseminated a robocall that used AI to impersonate President Biden. The robocall, which was made to thousands of New Hampshire voters over the course of just a few hours, also “spoofed” the phone number of the former New Hampshire Democratic Party chair, making her spouse’s phone number appear on recipients’ caller ID and including her personal cell phone number in the message itself. The robocall message told voters that “voting this Tuesday only enables the Republicans in their quest to elect Donald Trump,” and instructed voters to “save” their vote for the November election.

In making and disseminating these deceptive robocalls, the Defendants violated the Voting Rights Act, which bans intimidating, threatening, coercing, or attempting to intimidate, threaten, or coerce any person from voting. They also violated the federal Telephone Consumer Protection Act and state laws, which prohibit the dissemination of deceptive political robocalls or calls that do not accurately disclose their source.

Attempts to suppress and disenfranchise voters supporting a particular candidate or ballot measure represent a serious threat to our elections that cannot be ignored. Technology should not be abused to suppress the vote.

Unless we act now, the use of AI to manipulate voters won’t stop with New Hampshire. We need to win this case to protect citizens’ ability to exercise their right to vote free and unimpaired—the linchpin of all other civil and political rights.
