A bill package is going through Senate committee today that aims to remove important regulations preventing abuse and human trafficking in cases of surrogacy (using a surrogate mother to birth a child for another person or couple). Currently, Michigan law only allows for altruistic surrogacy (where no payment is exchanged). It also requires the child to be legally adopted, preventing the buying and selling of children, and ensuring they go to a safe home. If this bill package passes, these protections would be lost. Buying and selling children would be legal, opening up the doors to abuse and human trafficking. Surrogacy would bypass the adoption system entirely, removing important screening and checks. No marriage or formal relationship would be required of the parents. Any two people (or more) could sign together for a child. Surrogacy contracts would allow for predatory fine print that takes away the mother's right to object to an abortion (or punishes her for refusing one). No residency requirement is included, meaning Michigan would become an unregulated surrogacy tourist destination.
