I wanted you to be among the first to know: In collaboration with our partner,
the Mexican American Legal Defense and Education Fund (MALDEF), our legal team just filed a lawsuit challenging Texas’ draconian,
anti-immigrant law, S.B. 4. While the United States and two legal services organizations have already filed
suit against S.B. 4, our case is the first to represent an immigrant-member
organization and individual immigrants who would be personally impacted by S.B.
4.
S.B. 4 is Texas’ attempt to set up its own unconstitutional state immigration
enforcement program — ignoring the authority of the federal government to
enforce immigration law. It goes as far as authorizing law enforcement officers
from any one of Texas’ nearly 3,000 state and local law enforcement agencies to
arrest and detain immigrants suspected of entering or re-entering the country
without inspection. It also authorizes Texas judges to order them to return to
the country from which they entered — even if those immigrants have the federal
government's permission to be in the United States.
Texas is not above the law. S.B. 4 sets a dangerous precedent for states to subvert federal immigration
authority. It will violate the rights of people across Texas and those who seek
to enter Texas. We are committed to defending the rights, safety, and freedom of all immigrants
in Texas and that’s why we are headed to court.
