Hi friend,

The Securities and Exchange Commission (SEC) — the federal agency responsible for regulating markets and protecting investors — has issued an official ruling requiring publicly traded U.S. companies to disclose their climate-related risks and carbon emissions.

But here’s the problem, friend: These requirements require disclosures of only Scope 1 and Scope 2 carbon emissions. Scope 3, which creates the greatest amount of emissions, has been completely left out of the ruling.

Scope 3 encompasses the emissions from the entire supply chain of a company. That includes harvesting and transporting raw materials and distributing finished products, use, and disposal. These emissions typically add up to around 90% of a company's total emissions.

Overall, we are excited to see the SEC move forward with emissions reporting. But not including Scope 3 emissions is out of step with the global community. Other countries — the China stock exchange most recently — are leaning into much more comprehensive emissions reporting requirements.

Remember SB 253 and SB 261, the two climate disclosure laws we worked hard to pass into law in California last year? These laws go much further in emissions disclosure requirements than this SEC ruling by including all three scopes of emissions.

The fact is, carbon emissions and climate risks will have significant material effects on companies’ operations. Consumers and investors are both well aware of these risks, so it is time for our federal government’s rules to reflect that.
