Tell SCOTUS: No president should have "absolute immunity" for crimes they commit!

Even though the Colorado Supreme Court ruled that twice-impeached former president Donald Trump is disqualified from the ballot because he incited the white supremacist-led January 6 insurrection, the U.S. Supreme Court let Trump off the hook and ruled that he will remain on the ballot anyway.1 This week's upsetting decision affects voters not only in Colorado, but also Maine and Illinois, both of which were also seeking to remove Trump from the ballot, as well as voters across the country who were fighting to uphold our Constitution and keep an insurrectionist off their ballots and out of office.

This news comes just after the Supreme Court announced that it would take up Trump's "absolute immunity" appeal.3 Trump is facing 91 felony indictments, including ones for his interference with the 2020 election.4 Instead of letting the unanimous D.C. circuit decision stand, SCOTUS is aiding in Trump's delay tactics, scheduling the hearing for late April. 

Trump packed the Supreme Court with his nominees, and now they are paving the way for him to return to office. But SCOTUS doesn't decide the future of our country, we do. Sign the petition to make it clear that no president should have "absolute immunity" from crimes and attacks on our democracy.

Special counsel Jack Smith charged Trump with four federal felonies that accuse him of conspiring to overturn the results of the 2020 election, leading up to and on January 6.5 Trump is relying on the far-right members of the court to shield him from accountability and consequences—and so far, they are.

Dear MoveOn member,

The Supreme Court just announced that it would hear twice-impeached Donald Trump's claims that he should be immune from federal charges, including the indictments for his interference with the 2020 election—scheduling the oral arguments for late April and paving the way for Trump to continue to delay accountability and avoid facing trial before Election Day.6 In other words, this corrupt court, stacked with Trump's nominees, is clearing a pathway for Trump to return to office before the public can hear the case against him or the justice system has the chance to hold him accountable.

A D.C. circuit court ruled unanimously that Donald Trump does not have full, "absolute immunity" from ever being prosecuted for anything just because he was president.7 Trump is asking the Supreme Court to block this decision, granting him immunity from prosecution, clearly hoping that the right-wing justices—three of whom he appointed and one of whom has a direct conflict of interest in this case—will shield him from accountability yet again. Not on our watch.

The 14th Amendment of the Constitution explicitly states that elected leaders who have engaged in an insurrection can never hold public office again.8 And while we wait for the Supreme Court decision on whether Trump is even allowed on the ballot for his involvement in the January 6 insurrection, SCOTUS is further delaying the likelihood that voters will even have the chance to hear all the evidence of Trump’s crimes before they cast their votes in November.9,10

Donald Trump must be stopped. He is not above the law, and he and any other president should not have "absolute immunity" from prosecution for his crimes and attacks on our democracy.

Our democracy is under threat. Now more than ever, we have to make it clear: Nobody is above the law—especially not the leaders we elect. We must hold Trump accountable for the crimes he's committed; he cannot be deemed "absolutely immune."

Trump's legal argument that anyone who's been president has "absolute immunity" from prosecution for any crimes they commit couldn't be more dangerous or wrong. Just imagine what else he would attempt if that were the case.

Enough! No president, including Donald Trump, should have "absolute immunity" from being prosecuted. Will you sign the petition?

Last summer, special counsel Jack Smith charged Trump with four federal felonies for conspiring to overturn the results of the 2020 election, leading up to and on January 6.11 Yet Trump claims he should be fully immune from prosecution for the crimes he committed and is relying on the far-right, Trump-stacked court to save him.

Trump will exhaust all options to avoid accountability for the crimes he's committed. This is just his latest attempt, but if he's successful, the consequences are grave. If the Supreme Court insists on taking up his appeal, they must do so IMMEDIATELY and rule against him, denying Trump full, absolute immunity.

This isn't the last time the Supreme Court will weigh in on efforts to hold Trump accountable. As federal prosecutors prepare their case against him, the Supreme Court may be asked to determine if the trial can proceed. Donald Trump thinks he's above the law and should not be held to the same standards as the rest of us. And that’s really because he’s trying to get out of his federal election subversion criminal trial before November's election.

His thinking is, if he can just make it through the election and win, he'll get the chance to pardon himself. We can't let that happen.
