Three critical cases are heading to the courts in the next two months that could have grave repercussions for our patients’ access to care. This isn’t chipping away at what’s left of abortion rights since Roe v. Wade was reversed — it’s using a sledgehammer! And we need your support to fight back.
Case 1: The Supreme Court could turn back the clock on medication abortion.
The anti-abortion movement is trying to upend FDA approval of mifepristone, one of two medicines commonly used in medication abortion. The evidence is clear that mifepristone is safe and reliable. It has been FDA-approved for over 20 years and used by more than 5 million people. The Supreme Court is set to hear arguments on March 26.
Case 2: The Supreme Court could allow states to ban hospital ERs from providing emergency abortion care
The Emergency Medical Treatment and Labor Act (EMTALA) is a federal law that requires hospitals to provide patients with emergency care. By law, if a medical professional determines a patient in a hospital ER needs an abortion as stabilizing treatment, the hospital must provide that care. Despite the fact that this federal law has been in effect for decades, some states now want to prohibit hospitals from providing medically necessary abortion care. The Biden administration is suing Idaho over this issue and the Supreme Court will hear arguments on April 24.
Case 3: Texas is trying to shut down Planned Parenthood nationwide
In a politically motivated effort to take away patients' care and shut down Planned Parenthood and its Texas health centers, Texas joined an anonymous plaintiff to sue Planned Parenthood Federation of America and Planned Parenthood Texas affiliates for $1.8 billion. The baseless suit falsely alleges Planned Parenthood broke the law by getting reimbursed for birth control, cancer screenings, and other basic health care services they legally provided. A federal judge has ordered a trial in this case.
