Last week: The Supreme Court agreed to hear arguments on whether Donald Trump has broad immunity from federal prosecution in the DOJ’s January 6th case against Trump.

Yesterday: The Supreme Court allowed Trump to appear on the ballot, saying states do not have the authority to enforce Section 3 against federal candidates and disqualify him for inciting insurrection.

John, at first glance, these may look like big wins for Donald Trump and his campaign. But in our case, the Court chose not to clear Trump on the central issue: the question of Donald Trump’s culpability for his participation in an insurrection. They will likely stay silent on that issue in the immunity case as well.

In the face of an existential crisis for our democracy, the Court opted to let Trump off on a technicality.

But they said nothing to contradict Colorado’s finding that Trump engaged in insurrection on January 6th. That’s important.

That’s because the facts are plain and clear: Donald Trump incited an insurrection. The Supreme Court didn’t refute that fact – but now, the question becomes: will Trump get away with it?

There is not a single sentence in the Supreme Court's 14th Amendment opinions that disagrees with the finding that Donald Trump engaged in insurrection on January 6, 2021.

They could have easily cleared him. He asked them to clear him. They chose not to.

In fact, three Supreme Court justices even called Donald Trump an "oathbreaking insurrectionist” in their opinion.

Yes, they let him off on a technicality, but there is no question that Donald Trump is an insurrectionist.

To us, that means we need to redouble our efforts to hold him accountable.
